NOTE: These Driver Partner Terms are supplemental to and incorporated into the Terms of Service. By registering as a Driver Partner, you agree to both these Driver Terms and the general Terms of Service.
1. Driver Eligibility
1.1 Eligibility Requirements
To register as a Driver Partner, you must:
- Be at least 21 years of age
- Possess a valid U.S. driver's license and have held it for at least one year
- Own or have access to a vehicle in safe operating condition meeting applicable New York State requirements
- Carry valid automobile liability insurance meeting or exceeding New York State minimum requirements, including uninsured motorist coverage
- Possess a valid Social Security Number or Individual Taxpayer Identification Number (ITIN)
- Pass Washzi's background check screening process, which includes a criminal background check and motor vehicle record check
- Be legally authorized to work in the United States
- Own and maintain a smartphone compatible with the Washzi Driver App
1.2 Background Checks
Prospective Driver Partners must consent to and pass a background check conducted by Washzi's third-party background screening provider. Background checks may include criminal history, sex offender registry checks, and motor vehicle records. Washzi reserves the right to deny or revoke Driver Partner status based on background check results, at its sole discretion.
1.3 Ongoing Eligibility
Driver Partners must maintain their eligibility at all times. Any changes to your eligibility status — including license suspension, insurance lapse, criminal conviction, or change in immigration status — must be reported to Washzi immediately. Failure to disclose such changes may result in immediate account deactivation.
2. Driver Obligations and Conduct
2.1 Service Standards
Driver Partners agree to:
- Perform all pickup and delivery assignments with care, professionalism, and courtesy
- Handle Customer laundry with care and maintain the integrity of all items
- Follow all traffic laws and operate vehicles safely at all times
- Maintain a clean and sanitary vehicle interior during service
- Use the Washzi Driver App as directed
- Comply with all instructions provided through the App regarding pickup location, delivery address, and special handling instructions
2.2 Independent Contractor Acknowledgment
Driver Partners expressly acknowledge and agree that they are independent contractors and not employees, agents, servants, joint venturers, or representatives of Washzi for any purpose whatsoever.
Driver Partners specifically acknowledge that:
- They have the absolute right to set their own schedules, choose the hours they work, and log on and off the Platform at any time and for any reason
- They have the absolute right to decline, ignore, or reject any delivery assignment offered through the Platform without penalty or consequence
- They provide their own vehicle, smartphone, and all tools and equipment necessary to perform delivery services, and Washzi does not provide or reimburse any such items
- They bear all costs and expenses associated with performing delivery services, including vehicle fuel, maintenance, tolls, parking, insurance premiums, and telecommunications costs
- They are free to perform delivery services for any other platform, company, or individual at any time, including direct competitors of Washzi
- Washzi does not guarantee any minimum number of delivery opportunities, minimum earnings, or any particular level of work
- They are not entitled to any employee benefits from Washzi, including health insurance, paid time off, retirement benefits, workers' compensation coverage, unemployment insurance, or any other benefit
- Washzi does not withhold any income taxes, payroll taxes, Social Security contributions, or Medicare contributions from Driver Partner earnings, and Driver Partners are solely responsible for all such tax obligations
- Any misclassification claim, wage claim, benefit claim, or employment-related claim asserted by a Driver Partner against any third party arising from their use of the Platform is the sole responsibility of the Driver Partner, and Driver Partners agree to defend, indemnify, and hold Washzi harmless from any such claim
2.3 Prohibited Driver Conduct
Driver Partners are prohibited from:
- Operating their vehicle while impaired by alcohol, drugs, or any substance that affects driving ability
- Using a handheld mobile device while driving
- Allowing any unauthorized person to accompany them during an assignment
- Opening, inspecting, or tampering with Customer laundry other than as necessary to confirm order integrity
- Making personal use of any Customer property
- Engaging in abusive, threatening, or discriminatory conduct toward Customers, Laundromat Partners, or Washzi personnel
- Falsifying pickup or delivery records
3. Driver Compensation
3.1 Earnings Structure
Driver Partners earn a per-delivery fee for each completed assignment, the amount of which is displayed in the Washzi Driver App prior to acceptance of each assignment. Earnings may vary based on distance, order weight, demand, and any applicable surge pricing. Washzi may modify the earnings structure with 14 days' prior notice to Driver Partners.
3.2 Tips
Driver Partners receive 100% of all tips left by Customers through the Platform. Tips are paid in addition to the per-delivery fee.
3.3 Payment and Schedule
Driver Partner earnings are processed through Stripe and disbursed on a weekly basis, typically within 3–5 business days of the close of each weekly payment cycle. Driver Partners must complete Stripe's identity and banking verification to receive payment.
3.4 Taxes and Self-Employment
Driver Partners are solely responsible for all federal, state, and local taxes on income earned through the Platform, including self-employment taxes. Washzi will issue IRS Form 1099-NEC to Driver Partners who earn $600 or more in a calendar year, as required by law. Washzi does not withhold income taxes, Social Security taxes, or Medicare taxes from Driver Partner earnings.
3.5 Expense Responsibility
Driver Partners are responsible for all costs and expenses associated with performing delivery services, including vehicle fuel, tolls, parking, maintenance, insurance, and communication expenses. Washzi does not reimburse Driver Partners for any such expenses.
4. Driver Safety and Compliance
4.1 Traffic Law Compliance
Driver Partners must comply with all applicable federal, state, and local traffic laws, motor vehicle laws, and vehicle safety regulations at all times while performing delivery assignments. Washzi may implement safety features in the Driver App, including GPS tracking during active assignments, which Driver Partners consent to by accepting assignments. Washzi reserves the right to deactivate Driver Partners who receive multiple safety-related complaints or who violate traffic laws during the performance of assignments.
4.2 Auto Insurance Requirements
Each Driver Partner must, at all times during participation on the Platform, maintain at their own expense valid automobile liability insurance meeting or exceeding New York State minimum requirements, which includes:
- Bodily injury liability of no less than $25,000 per person and $50,000 per accident
- Property damage liability of no less than $10,000 per accident
- Uninsured/underinsured motorist coverage as required by New York law
Driver Partners are strongly encouraged to carry additional coverage given the commercial nature of delivery activities. Driver Partners must provide Washzi with proof of valid auto insurance upon request and within 48 hours of any such request. Failure to maintain required auto insurance is grounds for immediate account deactivation.
4.3 Vehicle Standards
Driver Partners must operate a vehicle that:
- Is registered and inspected in accordance with New York State law
- Is in safe operating condition with no known mechanical defects that could affect safety
- Is clean and sanitary in its interior cargo area
- Is not recalled for unrepaired safety defects
Washzi reserves the right to require Driver Partners to provide proof of vehicle registration and inspection status.
4.4 Accident Reporting
In the event of any accident, collision, injury, property damage, or law enforcement encounter occurring during a delivery assignment, the Driver Partner must:
- Immediately ensure the safety of all parties and contact emergency services as appropriate
- Notify Washzi at info@washzi.com within 24 hours of the incident with a written description of what occurred
- Cooperate fully with any Washzi investigation
- Not make any admission of liability or statement on behalf of Washzi to any third party
Failure to report an accident is grounds for immediate account deactivation.
4.5 Driver Indemnification of Washzi
Each Driver Partner agrees to defend, indemnify, and hold harmless Washzi and its officers, directors, shareholders, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- The Driver Partner's operation of a vehicle during or in connection with any delivery assignment, including any accident, injury, or property damage
- The Driver Partner's handling, delivery, or loss of Customer property
- Any violation of applicable law by the Driver Partner, including traffic violations, insurance violations, and tax violations
- Any employment or misclassification claim asserted by the Driver Partner against Washzi or any third party
- Any breach of these Driver Partner Terms
